Welcome to bestsiteaudit.com (“bestsiteaudit,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our website audit tools, reporting dashboards, APIs, and related software and services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms.

1) Eligibility & Accounts

  • You must be at least 18 years old and have the legal capacity to enter into these Terms.
  • Certain features require an account. You must provide accurate registration information and keep it current.
  • You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

2) Permitted Use & Site Scanning Consent

  • You may use the Services to audit websites you own or have explicit permission to analyze. You are solely responsible for obtaining any necessary rights/consents. Do not scan third-party sites without authorization.
  • Respect robots.txt, rate limits, and applicable laws (including anti-hacking, anti-spam, and computer misuse laws).
  • Prohibited uses include: disrupting networks; attempting to bypass security controls; uploading malware; infringing IP; or using the Services for unlawful, deceptive, or harmful purposes.

3) Subscription, Billing & Taxes

  • The Services may be offered on a subscription basis. By subscribing, you authorize us or our payment processor to charge your payment method on a recurring basis unless canceled.
  • Fees are exclusive of taxes; you are responsible for any applicable taxes.
  • Unless stated otherwise, all fees are non-refundable. Where required by law, you may be entitled to refunds or prorations.

4) Service Availability & Changes

  • We may modify, suspend, or discontinue features with or without notice. We will make reasonable efforts to avoid material adverse changes to paid plans.
  • We provide the Services “as is” and do not guarantee uninterrupted or error-free operation, or that reports are free from inaccuracies.

5) Reports, Data, and Your Content

  • You retain ownership of URLs you submit, crawl settings, uploaded files, and the audit outputs (collectively, “Your Content”).
  • You grant us a worldwide, non-exclusive license to process Your Content solely to provide and improve the Services (e.g., crawling, analyzing, generating reports, support, abuse prevention).
  • We do not claim ownership of your websites or third-party content they contain.

6) Intellectual Property

The Services, including software, design, interfaces, templates, and documentation, are owned by bestsiteaudit or its licensors and are protected by IP laws. We grant you a limited, non-exclusive, non-transferable license to use the Services during your subscription term in accordance with these Terms.

7) Confidentiality

Each party may access the other’s confidential information (e.g., non-public settings, pricing, or proprietary techniques). Each party will protect such information and use it only as necessary to perform under these Terms.

8) Acceptable Use—Automation & API

  • Do not circumvent usage limits, billing, or quotas.
  • Do not resell or white-label the Services without our written consent.
  • API keys are personal to your account and must be kept secure.

9) Warranties & Disclaimers

THE SERVICES AND ALL REPORTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant scan completeness, accuracy, or that our reports constitute legal, security, or compliance advice.

10) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER BESTSITEAUDIT NOR ITS SUPPLIERS SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US FOR THE SERVICES IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

11) Indemnification

You will indemnify and hold us harmless from claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from Your Content, unauthorized scans, or your breach of these Terms.

12) Term & Termination

  • You may cancel at any time through your account settings; cancellation takes effect at the end of the current billing cycle.
  • We may suspend or terminate for cause (e.g., non-payment, abuse, legal risk). Upon termination, your access ends and we may delete data according to our retention policy.

13) Governing Law; Dispute Resolution

These Terms are governed by the laws of Florida, excluding conflict-of-laws rules. Disputes shall be resolved in the courts of [Venue], unless arbitration is required by a separate agreement.

14) Changes to Terms

We may update these Terms from time to time. The “Effective Date” will reflect the latest version. Continued use after changes constitutes acceptance.
